MOU 08 & 17 City’s Response Final Settlement Proposal

We have for members of MOU 08 & 17 the City’s response to MOU 8 & 17 Final Settlement Proposal.

We have verified the legitimacy of the Documents and present them with the knowledge they may be subject to change but the likelihood of that is extremely slim.

This final proposal Will be submitted to the Members of MOU 08 & 17 and the past practice of the Union is to fail to provide the Actual Contract to the members as was the case in the ratification election and re-vote with MOU 18.

As much as I attempt to stop myself from highlighting the agreement it is something I can not resist as it draws attention to critical points.

I will remain unbiased and instead challenge the Leaders along with the bargaining Team members of MOU 08 & 17 to support or not support this agreement and Paul Kim to act responsibly or face the same fate as the MOU 18 Rep.

In the interest of fairness the Executive Board of this union should make certain that the Full text of the agreement as well as Unbiased voting information is presented to the members for their ratification vote.

Michael Hunt has taken a long journey on behalf of the MOU 08 & 17 members as have many others who led them away from EAA and into SEIU 721, Can they now tow the union line or will they speak honestly on the merits of this contract?

It is my belief that this contract is NOT what they had in mind when they began their journey and I can’t see the majority of the members or the bargaining team backing this contract.

Term: July 1, 2010 – June 30, 2014

Breakdown 2% increase in 2011 & 3% in 2013 comes out to 4 years +0.8% per year raise, minus 4% Increased Retirement totals -11% in contribution, -1.5% Salary reduction July 2011 to June 30, 2013, you do the math.

Retiree Health

  • Pro: Vests two-party retiree health benefit
  • Con: 4% Member Contribution effective 7/1/11 For Life

Contribution Offset-COLA

  • 2.00% Effective 7/3/11
    3.00% Effective 6/30/13

Step Freezes

  • Pro: None
  • Con: 2011-12 & 2012-13 in all departments and for all classifications Step Freezes shall apply to all steps for probationary, promotional or any other step movement.

Savings/Wage/Re-opener Based on the 4th quarter 2012 Financial Status Report:

  • Pro: Possible COLA or other compensation
  • Con:  Review the need for furloughs or other savings concessions in FY 2013-14

Furlough Guarantee

  • Pro: guaranteed no furloughs during first two years of the contract
  • Con: Furloughs dependent on F.S.R. for third year of contract and beyond

Management retains the right to impose layoffs

Citywide holiday shutdown 2011 & 2012

  • Pro: 4 Days off in 2011 & 2012
  • Con: 1.5% Salary Reduction beginning on July 3, 2011 and ending on June 30, 2013

Uniform allowances

  • Pros: Maintained for criminalists as currently defined.
  • Con: All other uniform allowances shall be dropped.

Contracting Out

  • In lieu of meet-and-confer, the parties agree to meet and discuss

Yesterday a group of RAP employees went to 3090′s office to hand deliver their votes and others to see why they had not received. This is what happened:

They could not get in at first: parking lots were locked, front/back door was locked. Had to bang on door until someone heard and came to open the door. Once they were in the bldg, Alice Goff is the person who helped them. She opened a 5-6″ book with all members names to check the address of a person who did not get the recent ballot. She was told that her address was wrong, the employee had lived there for 20+ yrs and received all the previous stuff including the last letter we got that the revote was coming in the mail soon.

We are being told the book had so many stickers indicating “wrong address” on ea page along with a “Y” or “N” next to all names.
When asked what the Y/N was for, no answer was given and ignored.

If you did not get your ballots, please go to the 3090 office to vote in person and see what is in that book next to your name.
I got my stuff and voted already “NO” but we are going down there today at lunch just to see what it says next to our names.

What happens when LA Cities Director Julie Butcher is sitting there holding her hand and makes no corrections?  We all know just how much Julie Butcher has to gain from this along with her partners Cheryl Parisi and Alice Goff, well At today’s Sanitation meeting at the SEIU 721 Local Mimi Soto was called out on her alleged lies and misdeeds to the point that she stormed out of the meeting and told the members to get their own information.

When asked how the members of  Sanitation/Street Services could hold a second election to correct the errors like MOU 18 was allowed she told them to “get a petition with 1700 members to sign” wow very very interesting to hear that she still can’t tell the truth to the members since the margin of defeat was only around 100.

I think the ONLY remedy SEIU 721 has is to immediately order a new election for MOU 04 since so many members of Sanitation were forced to vote on a contract they were completely misled on.

According to Sanitation Members they were promised:

  • Cash Overtime
  • Retirement contribution’s ended after 3 years
  • Cash Bonus was delayed (not eliminated)

and many more outright lies by some Union Staff and elected officials.

They were not provided the Contract they were voting on, and finally Today Mimi Soto stated flat out that she “Was Mistaken” on numerous contract facts when confronted.

Mistakes are small, telling outright lies about contract facts you have or should have had is not and the members were furious.  MOU 04 is now one step closer to a second election then ever before.

Dave Sanders, Julie Butcher, Mimi Soto, and the executive board have days to correct this egregious error. Hopefully we can upload the recordings of her meeting next week for all to enjoy.

Member Driven is gaining ground. I wonder how SEIU 721 attacking this website is working out for them? Looks like we still remain the best source of information for LA City Workers considering the unions are often “mistaken”.

LA Fire & Police exempt from retirement health care freeze

Just as was expected police and fire have had retirement health care subsidy talk all but ended.

LA City Council was dishonest in selling this to members and now the only ones who can laugh about it are the one who voted NO!

SEIU 721 continues to sell a bad deal to members due to the fear of decertification forcing to keep members locked in unable to leave.

Council suspends action on proposed freezing of sworn retiree medical subsidies

URGENT  -  Time-critical information

On April 12, 2011, the City Council considered a report from the Personnel Committee recommending that the City Attorney be instructed to prepare an ordinance for their consideration and vote to permanently freeze the retiree medical subsidies for LACERS and LAFPPS (Fire and Police) retirees at the current levels for all system members retiring on or after July 1, 2011.

After hearing comments from UFLAC President, Pat McOsker and LAPPL President, Paul Weber and after considerable debate, the Council voted to hold the matter over for another week pending an executive session briefing from the CAO relative to the status of current MOU negotiations for all of the affected bargaining units.

Yesterday, the matter came up again as scheduled.  As the result of considerable lobbying on the part of UFLAC and the LAPPL, a substitute motion was introduced and passed which, effectively, carved Fire and Police out of the forthcoming ordinance.  The Council moved forward on the freezing of the “civilian” subsidies.  The substitute motion further directs the CAO to report back to the Executive Employee Relations Committee within 14 days on all of the potential impacts and implications of a similar freezing of sworn retiree subsidies.

Although this matter is not yet resolved (and an easy resolution is not anticipated), there is no specific action or City recommendation regarding the freezing of our retiree medical subsidies pending at this time.

Due to yesterday’s Council action, it would be premature for us to advise members to consider altering their anticipated retirement dates in order to avoid becoming subject to a potential freezing of their post-retirement medical subsidies.  However, that could change.
